If you are a commercial truck driver and you can’t drive after your truck accident, the issue for you, of course, is going to be income and not having any. Under Florida law, PIP insurance, personal injury protection, allows you $10,000 of coverage which can be used either for medical expenses or for lost wages. That will help a little bit but it only covers 60% of your lost wages. The fact of the matter is that you are entitled, as part of your damages, to recover any lost earnings and future earning capacity. You need to keep track of that, you need to keep record of what you were making or would of made, and ultimately your attorney should be including that as part of your settlement demand, part of the amount of damages you’re entitled to recover.
