If I was hit by a commercial vehicle in a Florida car accident, is the employer of the other driver also responsible?

I was injured in a Florida motorcycle accident, but I wasn’t wearing a helmet. Can I still recover damages from the other driver?

If you are involved in an accident with a commercial vehicle, the employer of the driver is also responsible. If the employer owned that vehicle, they automatically would have liability. But even if the vehicle was not owned by the employer, if the employee was acting within what we call the course and scope of their employment, the employer would be liable. What we mean by that simply is: Was the employee working at the time of the accident?
