Must a settlement in a wrongful death case be shared by all relatives?

Is there a time limit to file my Florida car accident lawsuit?

My child wants to play football, and the team wants me to sign a waiver saying that I won’t hold the league responsible if/he gets hurt. Should I sign it?

No. A wrongful death settlement in Florida is not necessarily shared by all relatives. In fact, a wrongful death claim in Florida can only be brought by the personal representative of the estate. The settlement derived from that personal claim or that wrongful death claim will go to the benefit of the estate and those who are the beneficiaries of the estate.

If the person died in testate without a will, that means that the proceeds of the estate would go to the next of kin. If that person died with a will, the will would designate who the parties are who are the beneficiaries to receive any proceeds from the estate.
