If the other driver in your Florida car accident does not have insurance and the accident was their fault, you have two options. Number one, that other driver, the at-fault driver is always, in legal theory, liable for the accident and liable for your damages. However, the more practical answer is, hopefully under your own insurance policy, you have what we called UM coverage, uninsured or under-insured motorist coverage. If you do, that insurance coverage would apply and cover your damages, assuming that you have sufficient coverage.
